The Australian Government’s Department of Foreign Affairs and Trade has published what purports to be the final text of the Anti-Counterfeiting Trade Agreement (thanks to the IPKat for the lead on this). The ACTA text can be viewed here. It is stated to be ‘subject to legal review’.
Section 5 of the Agreement deals with ‘Enforcement of Intellectual Property Rights in the Digital Environment’ but obviously other elements in the Agrement are of relevance to IT lawyers too. It is anticipated that the signatories will be as follows: Australia, Austria, Belgium, Bulgaria, Canada, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Japan, the Republic of Korea, Latvia, Lithuania, Luxembourg, Malta, Morocco, the Netherlands, New Zealand, Poland, Portugal, Romania, Singapore, Slovakia, Slovenia, Spain, Sweden, Switzerland, the United Kingdom, the United Mexican States, the United States and the European Union.
The agreement, which is subject to legal review, follows the conclusion of three years of negotiations.
