Although the ICO published statutory guidance on monetary penalties under s. 55C (1) of the Data Protection Act 1998 in 2010, they are now consulting on a proposed revision of that guidance because the Information Commissioner has new powers to issue monetary penalty notices for serious breaches of the Privacy and Electronic Communications (EC Directive) Regulations 2003.
The consultation is open until 27 September 2011.

This consultation is intended to look specifically at the areas of the guidance that refer to the Regulations, not to consult more widely on the use of the Information Commissioner’s powers to issue monetary penalty notices.
