SCL Mediation Scheme (SCLM)

SCL is pleased to introduce the SCL Mediation Scheme (SCLM) – a new initiative designed to facilitate the consensual resolution of technology disputes in England and Wales.

Developed by SCL members Paul Berwin and Damian Croker, the scheme provides a structured mediation process for resolving disputes arising from contracts for the provision of technology-related goods and services. This includes, but is not limited to, disputes involving software development, outsourcing, systems integration, IT consultancy, software licensing, blockchain/smart contracts, artificial intelligence, and cloud computing. The scheme is not limited to disputes about technology itself; it also extends to commercial disputes within a technology-driven context.

The SCLM was officially launched at the SCL AI Conference on 8 October 2024 in London.

SCLM Mediation Panel (with more members to be announced):

The panel consists of legal and non-legal professionals with extensive experience in both technology and dispute resolution. Each application to the panel undergoes a thorough assessment to ensure candidates meet the required eligibility standards, with final approval granted by the SCL Board of Trustees. The panel is subject to regular review to maintain the highest standards of expertise.

SCL Adjudication Scheme (SCLA)

The SCLM will sit alongside the SCL Adjudication Scheme (SCLA)—SCL’s established three-month procedure for resolving technology disputes. Like the mediation scheme, SCLA covers a wide range of tech-related contractual disputes, including software development, outsourcing, systems integration, IT consultancy, licensing, blockchain/smart contracts, and cloud computing.

With both schemes now available, SCL offers a robust framework for resolving technology disputes efficiently and effectively.
